10/14/05 Judge Who? It would be interesting and perhaps instructive to list the justices who have served on the U.S. Supreme Court who, according to self-appointed conservative judicial experts (with whom I very frequently agree on other issues) should never even have been appointed because they had not demonstrated the appropriate judicial experience. Here is the list of justices who have never been judges (compiled from http://www.oyez.org/oyez/portlet/justices/): John G. Roberts, Chief Justice William Rehnquist, the late Chief Justice Byron R. White Earl Warren John Marshall James Wilson William Paterson Bushrod Washington Joseph Story Henry Baldwin Roger B. Taney John McKinley Benjamin R. Curtis John A. Campbell Nathan Clifford Noah Swayne Salmon P. Chase Joseph P. Bradley Morrison R. Waite Lucius Q. C. Lamar Melville W. Fuller George Shiras, Jr. William H. Moody James C. McReynolds Louis D. Brandeis George Sutherland Pierce Butler Charles E. Hughes Owen J. Roberts Stanley Reed Felix Frankfurter William O. Douglas Harlan Fiske Stone James F. Byrnes Robert H. Jackson Harold Burton Tom C. Clark Arthur J. Goldberg Abe Fortas Lewis F. Powell, Jr. All told that is about 36% of the Justices that have ever served on the U.S. Supreme Court. That is the list of people the detractors of Harriet B. Miers must distinguish from her in significant ways in order to sustain the otherwise arbitrary charge that President George W.
